1. Seller

These Terms of Sale govern the purchase of the Cresci Device from HeartQuake Sagl.

2. Product

The "Cresci Device" is a 14-inch Wi-Fi touchscreen running a custom Cresci launcher. Use of the device requires an active Cresci subscription, which is purchased separately through the Cresci application.

3. Price, shipping and taxes

  • Device price: €169, payable in full via Stripe at the time of order.
  • Shipping within the European Union is included in the price.
  • Because HeartQuake Sagl ships from Switzerland, orders arriving in the European Union are subject to local import VAT and customs handling fees, paid by the recipient directly to the courier on delivery. These amounts are not collected by HeartQuake Sagl. Typical range: €25–35 depending on the destination country.
  • HeartQuake Sagl is not currently VAT-registered.

4. Availability and delivery

  • The first batch of devices is limited to 20 units.
  • Orders are currently accepted from European Union member states only.
  • Estimated delivery time: 6 to 8 weeks from the date of order. By placing an order you agree to this delivery window, which extends the 30-day default under Article 18 of Directive 2011/83/EU.
  • If delivery is not possible within the agreed time, you may terminate the contract and receive a full refund of the device price.

5. Right of withdrawal

HeartQuake Sagl voluntarily grants buyers the 14-day right of withdrawal modelled on the EU Consumer Rights Directive (2011/83/EU). You may withdraw from the purchase within 14 days of receiving the device, without giving a reason.

To exercise your right of withdrawal:

  • Send a clear statement to hardware@cresci.kids within 14 days of delivery, stating your decision to withdraw from the contract.
  • Return the device in its original, undamaged condition to the return address you will receive by email after notifying us.
  • The cost of return shipping is borne by the buyer.
  • HeartQuake Sagl will refund the €169 device price within 14 days of receiving the returned device.
  • Import VAT and customs handling fees paid to your courier on delivery are not refundable by HeartQuake Sagl. You may be able to reclaim them from your national customs authority — please check with them directly.

6. Warranty

HeartQuake Sagl provides a 24-month commercial guarantee on the device against manufacturing defects, consistent with the EU Consumer Sales Directive. Damage caused by misuse, drops, liquid exposure, or unauthorised modification of the device or its software is excluded.

7. Subscription requirement

The device shows a setup screen on first use and requires an active Cresci subscription to become fully functional. The device price does not include any subscription. If your Cresci subscription is later cancelled, the device will return to the setup screen until a subscription is reactivated.

8. Payment

Payment is processed by Stripe at the time of order. HeartQuake Sagl does not store your payment card details.

9. Governing law and disputes

These Terms are governed by Swiss law. Buyers resident in a European Union member state retain the mandatory protections of their home country's consumer law, including access to the competent courts of that country. Disputes may also be submitted to the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

10. Changes

These Terms apply to orders placed on or after the date shown at the top of this page. We may update these Terms; the version in force at the time of your order governs it.
